Terms and Conditions for Les Roues Vertes Rental of Gîtes

(valid from 1 November 2012) 

Definitions used in the following terms and conditions

  • The Property – part of the property known as Les Roues Vertes is offered for holiday rentals in two units (“the gîtes”)
  • The Owners - Stuart and Shona Patterson occupy the remaining part of the property
  • Party Leader - the person signing the booking form is deemed to be the party leader and is responsible for all members of the party adhering to these terms and conditions.
  • The Guests - all members of the party

Property description

Whilst every effort has been made to ensure that the description of the property and nearby facilities is as accurate as possible, we cannot accept any liabilities for any changes or alterations.

Reservations

To reserve one or more gîtes, the party leader should initially email or telephone to assess availability. The owners will then hold the holiday for one week whilst an invoice is sent out and awaits signed booking form together with payment of the initial 25% deposit per gîte.

Payment schedule

  • - 25% of total rental cost as deposit on booking
  • - 75% of total rental cost
  • - £150 breakage deposit on arrival. See 5. below.

Reservations made within 8 weeks of arrival date should be paid in full at time of booking.

In the event of late payment, the owners reserve the right to cancel the booking, retain the deposit, and re-let the property. Any such cancellation will be given in writing. Bookings made within eight weeks of the start of the rental period must be paid in full at the time of booking.

Breakage deposit

A breakage deposit of £150, for each gîte, for the rental period is required in case of, e.g., damage to the property or its contents. However, the sum reserved shall not limit the guest’s liability to the owners. The owners will account to the guests for the breakage deposit & refund the balance due within one week of the end of the rental period.

Payment methods

The owners accept payment in either Sterling or Euros. There is no extra charge from us for payment in either currency; however, your own bank may charge you for a Bank transfer. Please ask for details of the following options.

  • Bank cheque – made payable to “Mr Stuart Patterson”.
  • Bank transfer.

Price for rental (the charge) is for the number of guests specified by the party leader, subject to the maximum occupancy stipulated by the owners, which must not be exceeded. Infants and young children should be included when stating the numbers in the party.

The charge is inclusive of water, electricity, gas, fuel and all linen. A supplementary charge for electricity and / or fuel usage may be levied for low season rentals. Guests are free to bring their own linen, but no reduction in the charge will be made.

Booking confirmation

On receipt of the party leader's completed booking form and cleared deposit, a confirmation of booking and receipt will be issued (by letter or email as appropriate). This constitutes a formal agreement between guests and owners.

Provisional bookings will be held for up to seven bank working days to allow for postal/electronic receipt of the initial deposit.

Booking is confirmed on the understanding that the accommodation booked will be available for the dates specified. If this is not possible, due to circumstances beyond the owner’s control, the owners will make a prompt and full refund of all money paid, and there will be no further claim against the owners. In the event of the booking being cancelled or altered by reason of force majeure (which includes floods, storms, riots, strikes, wars, and Acts of God) or other events outside the owner’s control, the owners cannot accept liability.

If the guests or any other person in the party falls ill whilst on holiday, or for any reason has to return early, the owners cannot be responsible for any additional costs incurred, nor can any part of the charge be returned.

Alterations to original booking

Alterations should be made in writing and will be subject to a £15 administration charge. If alterations are made 0 - 56 days before arrival and cannot be catered for, the owner/agents reserve the right to enforce the cancellation fee as detailed below. (subject to availability)

  • Cancellation by Party Leader - This should be made in writing to the owners.
  • Cancellation charges - From the date of receipt of the cancellation letter.
    • More than 90 days before arrival date - 25% of total cost
    • 90 - 57 days before arrival date - 50% of total cost
    • 56 - 0 days before arrival date - 100% of total cost

If it is possible to re-let the property after cancellation, full refund minus £15 administration charge will be made.

Cancellation by the owner

If for any reason the owners is obliged to cancel the Party Leader’s booking; all monies paid to date will be refunded in full. This is the limit of the owner's liability.

Rental Periods

The rental period shall commence at 4.00pm on the first day & finish on 10.00am on the last day. The owner shall not be obliged to offer accommodation before the times stated & the guest shall not be entitled to remain in occupation after the time stated. Some flexibility may be available during the low season or out of season periods. Please ask the owners in advance.

Cleaning

Equipment is provided and guests are responsible for leaving the gîte and its contents clean and tidy. This includes washing up, cleaning the oven, basins, showers, WC's, floors, folding bedding and returning all furniture to its original position. If, in the opinion of the owners, the gîte has not been satisfactorily cleaned, a cleaning charge of £15 per hour will be deducted from the breakage deposit.

Heating

Heating charges are included in the rental charge and where applicable the boiler will be set and timed. In colder weather logs are available for the wood burner.
Unlimited hot water is available at all times.

Smoking

No smoking is allowed in the gîte or shared areas - please dispose of cigarette ends in a clean and responsible manner.

Pets

No pets of any kind are allowed in the gîte or grounds. An exception may be made for registered guide dogs. Please ask in advance of booking.

Parking

Free on-site, off road parking.

Swimming pool

10m x 5m, is open from May to October and complies with 2004 French Safety Regulations. Cleaning and maintenance of the pool is included in rental rates. There should be no unauthorised use of pool equipment and children should be supervised at all times.

Risk and Safety

The use of the accommodation & amenities, such as the swimming pool, boules pitch, games, barbecue etc. is entirely at the guests risk & no responsibility can be accepted by the owner for any injury or loss or damage to the guests & their belongings.

No matter how much care is taken, gîtes are not childproof. The owners will not be held responsible for any accidents occurring within the gîte or grounds.
guest’s responsibilities

The guests agree to be a considerate tenant & to take good care of the property. The guest also agrees not to act in any way which would cause disturbance to those residents in neighbouring properties. It is the parent’s responsibility to ensure their children are supervised at all times.

Owner’s liability

The owner shall not be liable to the guests for:

  • Any temporary defect or stoppage in the supply of public services to the property, nor in respect of any equipment, plant, machinery or appliance in the gîte, garden or swimming pool .
  • For any loss, damage or injury which is the result of adverse weather conditions, riot, war, strikes or other matters beyond the control of the owner
  • For any loss, damage or inconvenience caused to or suffered by the guest if the property shall be destroyed or substantially damaged before the start of the rental period & in any such event, the owner shall, within seven days of notification to the guest, refund to the guest all sums previously paid in respect of the rental period.

Under no circumstances shall the owner’s liability to the guest exceed the amount paid to the owner for the rental period.

Complaints

Complaints must be reported to the owners as soon as possible or at least within 24 hours. The owners would prefer the opportunity to deal with any complaint at the time, as complaints cannot be accepted after departure. The guest shall report to the owner without delay any defects in the gîte or breakdown in the equipment, plant, machinery or appliances in the gîte, garden or swimming pool & arrangements for repair and / or replacement will be made as soon as possible.

Disputes

These conditions and any contract to which they apply are governed and construed in accordance with English law and are subject to jurisdiction of the courts of England and Wales. All disputes arising from the interpretation, fulfilment or application of this contract will be subject to the jurisdiction of the courts of England and Wales.

Insurance

The guests must take out adequate holiday insurance cover, which must include personal liability incurred with respect to major damage to gîte or pool caused by the guests or any members of the party.

The owners cannot accept any responsibility whatsoever for any injury or damage to guests or any of their property whilst using the gîte, grounds, bicycles, swimming pool or car park.

Inventory

Please check the inventory on arrival and make a note of any damaged/missing items on the gîte inventory sheet. Similarly, record and date any breakages/damages during your stay. The owners reserve the right to charge for any broken / damaged / missing items. If such sums exceed the breakage deposit, the guests agrees to pay for replacement of these items in full within 4 weeks of departure.

Safety

Guests agree to take all precautions necessary to ensure the safety of members of their party and to avoid all dangerous activities within the property. Guests are responsible for ensuring that minors are supervised at all times.

The swimming pool conforms to French security requirements. Guests must ensure that the pool fence gate is allowed to close freely. No glasses (including bottles and cans), sharp objects, or smoking are allowed within the pool area.

Please respect and show consideration for your surroundings and your neighbours. Any guests deemed to be acting in a consistently unreasonable manner will be asked to quit the property.

Disclaimer

The owners cannot accept any responsibility whatsoever for any injury or damage to guests or any of their property whilst using the gîte, grounds, bicycles, swimming pool or car park.

Acceptance of these terms and conditions

Completing the booking form implies knowledge and acceptance of these terms and conditions.
